Terms and Conditions

The following terms and conditions apply to all transactions on www.tamarindtreeoriginals.co.uk and www.tamarindtreeoriginals.com. The placing of an order indicates that you, The Customer, accepts these terms and conditions. Please read them carefully and print for future reference. These terms and conditions do not affect your statutory rights. To order goods through this website you must be at least 18 years of age. We will treat each order for goods as an offer by you to purchase the goods subject to these terms and conditions.

Quality and guarantees/images and specifications

Tamarind Tree Originals endeavour to select and purchase goods of the highest quality from a variety of mostly overseas suppliers. Each item is unique in design and colour. We supply limited numbers of each item to ensure individuality for our clients. Many of our designer items are hand made in India and China and other Asian countries and designs, fabrics and prices are liable to variations and change. Tamarind Tree Originals seek to source from smaller hard working communities where local people benefit through fair wages and working conditions. As a result products can lack the uniformity of mass production. All purchases are made bearing these facts in mind.

Whilst we at Tamarind Tree Originals endeavour to ensure all images and specifications are correct at the time of publication, they do vary. As such we can accept no responsibility for incorrect images/information.

All images, descriptive matter, specifications and advertising are for the sole purpose of giving an approximate description of the goods. Goods are not sold on a trial basis.

Typographical Errors

In the event that a product is listed at an incorrect price due to a typographical error or error in pricing information, Tamarind Tree Originals will have the right to cancel any orders based on the incorrect price whether or not the order has been confirmed.

Payment method

This is an international site. Accepted methods of payment are by credit card through PayPal or by cheque drawn on United Kingdom Banks endorsed on the reverse side with cheque card guarantee number. For cheque payment, funds will be cleared fully before goods are despatched. On the order the Customer must provide Tamarind Tree Originals with the exact address and telephone contact number that your credit card issuer has on file for you. The Customers order will only be processed once full payment for the item plus postage and packing charges has been received.

Tamarind Tree Originals reserves the right to refuse an order. A full explanation for this refusal will be given if requested.

Availability of goods

All products are subject to availability and may be withdrawn at any time. Tamarind Tree Originals will contact the Customer within 7 working days of the order being received if the product is currently out of stock. If you, the Customer, do not wish to proceed with the order, or for any reason we cannot supply the items requested we will arrange for the order to be cancelled and any monies already paid for the specific order will be refunded.

Delivery

Tamarind Tree Originals undertake to despatch all orders within 7 working days of cleared funds. We will only ship to the billing address if payment is made by credit card. Every effort will be made to keep to the delivery date. Tamarind Tree Originals will not, however, be liable for any losses, costs, damages or expenses incurred by the Customer or any other person or company arising directly or indirectly out of any failure to meet any estimated delivery date. Unless otherwise agreed Tamarind Tree Originals may deliver by instalments. Should the Customer request that delivery be by instalments, a further agreed carriage charge will be applicable. Failure by the Customer to pay for any instalment or delivery when due will entitle Tamarind Tree Originals to withhold further deliveries. Delivery of the items ordered shall be made to the Customers address and the Customer shall make all arrangements necessary to take delivery of the items.

Returns Policy

Orders cancelled after despatch of the goods will be subject to credit only once the items are returned to Tamarind Tree Originals and receipted back. If the items are accepted by the Customer, opened and used the Distance Selling Regulations will apply. In all instances goods must be returned as new, with no blemish, defect or parts missing, nor any damage to the outside packaging. For any damage or defaced garments or packaging, a fee of 25% of the refunded monies will be deducted prior to refund.

All returns should be received by Tamarind Tree Originals within 10 working days of receipt of goods by the Customer.

Shortages

It is the responsibility of the Customer to check and confirm that the correct number of packages have been delivered before signing the delivery manifest/consignment note of the carrier. It is the responsibility of the Customer to notify Tamarind Tree Originals of any shortages within 48 hours of delivery and to register the shortage of packages with the carrier concerned.

Time limitation for notification of claims

Damaged in transit

Some damage to goods cannot always be identified on delivery. The Customer must sign the delivery manifest as unchecked. Should any damage be noticed upon opening the package, Tamarind Tree Originals must be advised of the exact damage within 48 hours of delivery. All claims against the carrier will need the evidence of damaged packaging. The Customer is requested not to dispose of any damaged packaging relating to deliveries from Tamarind Tree Originals. The claim will be handled by Tamarind Tree Originals who will arrange to collect the damaged goods and packaging. Where appropriate and availability allows replacements will be sent.

Tamarind Tree Originals cannot accept any responsibility where the above time scales are not followed.

Incorrect goods

It is the Customers responsibility to notify Tamarind Tree Originals within 48 hours of receipt of any incorrect goods supplied. Tamarind Tree Originals will request details of the items supplied to check against the original order. Tamarind Tree Originals will seek to negotiate a fair resolution where difficulties arise through the Customers inability to stick to the time scale.

Non Deliveries

Tamarind Tree Originals will not accept responsibility for goods lost in transit unless we are notified within 5 days from the expected delivery date. The expected delivery date, in normal circumstances, will be within 7 10 days of the receipt of full and cleared payment. Items no longer required (not applicable for faulty goods) If you, the Customer, are not totally satisfied with your item/s from Tamarind Tree Originals, you can return it/them within 7 days from receiving the item/s for a refund provided each item is in pristine condition and in its original packaging. The Customer will be responsible for the safe return of the goods.

Refunds

All refunds issued will be via the same payment method as on the original order. Please allow up to 10 working days for a refund to be credited. Tamarind Tree Originals do, however, reserve the right to refund the Customer within 30 days of the return.

Liability

Except as may be implied by Law and except in the case of death or personal injury where the Customer is dealing as a consumer, in the event of any breach of these Terms and Conditions by Tamarind Tree Originals , the remedies to you shall be limited to damages which shall in no circumstances exceed the price of the Goods and Tamarind Tree Originals shall under no circumstances be liable for any indirect, incidental or consequential damages.

Force Majeure

Tamarind Tree Originals will not be under any liability whatsoever in the event that we are prevented or delayed from supplying or making delivery of any goods for any reason or cause beyond our control.

No Waiver

The failure of Tamarind Tree Originals to insist upon strict performance of any provision of these Terms and Conditions shall not be deemed to be a waiver of our rights or remedies in respect of any present or future default of the Customer in performance or compliance with any of these Terms and Conditions.

Severability

In the event that any or part of these Terms and Conditions shall be determined invalid, unlawful or unenforceable to any extent such term, condition or provision shall be severed from the remaining Terms and Conditions which shall continue to be valid and enforceable to the fullest extent permitted by law. These Terms and Conditions shall be construed within English and United Kingdom Law.
